August 29, 2024 - Slow Progress in Tepezza MDL

The next status conference in the Tepezza MDL is scheduled for September 5, 2024. Earlier this summer, the defense sought to banish a bellwether discovery case by filing a motion to dismiss, citing that the plaintiffs failed to state a claim.

Oral arguments over this motion are set for October 16, 2024, but the decision will only affect that specific case. Other than this, August hasn't been very busy in the Tepezza MDL.

August 20, 2024 - Deposition Agreement Reached in Tepezza MDL

The parties in the Tepezza MDL have reached an agreement over the number and scheduling of depositions. According to the Joint Status Report, they have agreed on a total number of depositions and to split them into two phases: the first phase will finish by February 14, 2025, and the second will run from then until April 10, 2025.

They also reached a consensus on some procedural aspects of the depositions. We still believe these cases may settle more quickly than typical MDLs, potentially well before the first bellwether trial in 2026.

July 30, 2024 - Ongoing Deposition Dispute in Tepezza MDL

Horizon recently filed a motion to dismiss that we expect to fail. Meanwhile, attorneys from both sides in the Tepezza MDL are set to meet to address disagreements over the scope and quantity of corporate and expert witness depositions. The defendants aim to limit the number of corporate depositions, while the plaintiffs want as many as possible.

A report on the progress of these negotiations is expected to be submitted to the MDL judge sometime this week.

July 17, 2024 - Tepezza Settlement Mediation Approaches

This month, a mediation will be held to settle the Tepezza cases. We don't think it will pan out but there is always hope that they can make some progress toward a settlement.

July 12, 2024 - Mixed News in Tepezza Litigation

The Tepezza litigation has seen both positive and negative developments. On the positive side, the court has set dates for the bellwether trials:

  • First Bellwether Plaintiff Trial: March 9, 2026
  • Second Bellwether Plaintiff Trial: May 4, 2026
  • Third Bellwether Plaintiff Trial: June 29, 2026
  • Fourth Bellwether Plaintiff Trial: August 24, 2026

However, the downside is that the first trial is still 20 months away. There is speculation about the possibility of an early settlement before reaching 2026, which is unusual in MDLs but could happen given the smaller scale of this litigation.

July 2, 2024: More Tepezza Cases File in July 2024

As of July 2024, 138 lawsuits related to hearing loss purportedly caused by Tepezza were pending in multidistrict litigation (MDL).

These cases are still in the early stages, with no trials scheduled or settlements reached yet. However, on June 11, 2024, the court selected a group of 12 cases to serve as bellwethers.

Discovery for these bellwether cases will proceed over the coming months, with four trials expected to occur in 2026.

April 8, 2024: Tepezza Litigation Continues to Grow

As of date, there are now 107 Tepezza lawsuits that have been filed into the MDL and pending in
United States District Court for the Northern District of Illinois. The case uniformly claim that
Tepezza infusion treatment caused incomplete or complete hearing loss.

March 19, 2024: Modifications to Tepezza Lawsuit Deadlines

Lawyers on both sides have agreed to step up the deadlines that were decided in a previous court order. This includes selecting the group of initial bellwether cases and clarifying procedures that will affect expert witnesses. These adjustments are meant to streamline the litigation process.

March 6, 2024: Waiting on the Results of the Status Hearing

A status hearing was held to discuss the progress of the Tepezza MDL. However, we don't know what happened in that hearing. Public information on what was discussed or any decisions that were made might take some time to become available.

March 1, 2024: Increase in Lawsuit Filings

The Tepezza MDL saw a significant rise in new cases last month. A total of 19 new hearing loss lawsuits were transferred into the MDL, bringing the total number of pending cases to 93. This is the highest monthly increase in claims since the start of the MDL.

February 8, 2024: Discovery Progress and Agreement

The Tepezza hearing loss MDL has continued its slow growth. Both parties have agreed to document production by Horizon, which signifies some movement forward in the discovery phase of the litigation. Now, they can start exchanging information and documents.

However, this process likely won't be completed until the end of 2024 which means it might take longer for attorneys to analyze the information and more time to reach settlements with plaintiffs. This means settlements for the Tepezza lawsuits are not likely to start until 2025.

January 31, 2024: Status Hearing and Slow Start

The next status hearing for the Tepezza hearing loss MDL is scheduled for March 6, 2024. Since the MDL's establishment in June 2023, only 33 additional cases have joined, which is a slow start to the MDL lawsuit.

January 9, 2024 - Request for Additional Review Time in Bellwether Case Selection

A motion was filed to consolidate all the Tepezza hearing loss cases into multidistrict litigation (MDL) due to 18 different cases pending across five federal districts. The Northern District of California seems to be the preferred venue.

December 13, 2022 - Patience May Need a Second Injection of Tepezza

Tepezza is now saying that patients of thyroid eye disease (TED) may require a second round of injections to benefit from the drug. This constitutes a serious concern for people who know that Tepezza may elevate the risk of permanent hearing loss or tinnitus.

What Are Defective Prescriptions and Is Tepezza Defective?

Some prescription medications have adverse side effects that outweigh the drug’s promised benefits. These drugs are considered defective prescriptions, and many users do not know about or understand the potentially dangerous consequences they face when taking these meds. In fact, a recent study linked Tepezza to potential dangerous side effects, including hearing loss and persistent ringing in the ears known as tinnitus.

Tepezza Study Discloses Potential Serious Side Effects in 65% of Patients

Doctors commonly prescribe Tepezza for patients with thyroid eye disease, also known by its generic name: teprotumumab. Patients receive regular injections of Tepezza to help reduce eye bulging and slow the effects of TED.

In 2021, the Stanford University School of Medicine conducted a small study of Tepezza users. The results showed that 65% of the participants experienced adverse effects, including hearing loss, ringing in the ears, and muffled hearing. Some impairments appear permanent, but more time is needed to confirm this conclusion because the study only followed the participants for three months.

This percentage of affected users is far greater than the initial clinical studies provided by the drug manufacturer. The preliminary tests submitted to the Food and Drug Administration (FDA) by Horizon Therapeutics reported only 10% of users might have hearing-related issues.

The primary complaints reported in the recent study include:

  • Autophony - the sensation that your own voice is loud in your ears,
  • Tinnitus - persistent ringing in the ears,
  • Subjective hearing loss, and 
  • The feeling that your ears are plugged.

Three of the patients developed Patulous Eustachian Tube disorder, where the tubes that run from the back of the throat to the middle ear stay open. Normally, these channels should only open when you need to regulate air pressure around your eardrums, for example, during a sneeze or abrupt change in altitude.

Some of the study participants’ issues improved after a few months, while others did not. The researchers recommended further studies to evaluate these risk factors and better inform patients who are considering using Tepezza. Meanwhile, mass tort Tepezza lawsuits are growing to protect Tepezza users and provide compensation for their losses.
