August 27, 2024 - Court Orders Key Disclosures in Gerber Baby Food Lawsuit including Test Results, Other Defendants, and Preservation of Evidence
During the Case Management Conference at the end of August, the court issued important orders that will likely be very beneficial for the plaintiffs in the Gerber Baby Food Lawsuit.
First, the defendants must provide the results from all the tests conducted on baby food for heavy metals from 2012 to 2021. Additionally, the water used in making the baby food was also tested, and the defendants will now also be required to disclose all these test results to determine if heavy metals were present during that period. They are also required to show the steps they took to preserve the evidence related to these tests and to reveal when they began preserving this evidence.
The court is also requiring that the defendants identify any third-party companies involved in producing the baby food during the same 2012-2021 time period.
